Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pomalo Corporation ("Company," "we," "us," or "our"), governing your access to and use of the ServiceArc platform located at servicearc.io, including all related services, features, and SMS notification capabilities.

By accessing or using ServiceArc, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.

ServiceArc is a software-as-a-service (SaaS) platform operated by Pomalo Corporation. Among its features, ServiceArc provides SMS notification services to deliver alerts, reminders, status updates, and other communications to users via text message. SMS delivery is facilitated through Twilio, a third-party communications platform.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use ServiceArc. By using the platform, you represent and warrant that you meet these requirements.

To access ServiceArc, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

You agree not to use ServiceArc to:

• Violate any applicable law, regulation, or third-party rights.
• Send unsolicited, unauthorized, or spam messages through the platform.
• Transmit any content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.
• Interfere with or disrupt the platform, servers, or networks connected to ServiceArc.
• Attempt to gain unauthorized access to any part of the platform or its related systems.
• Use the platform for any purpose that is fraudulent or deceptive.
• Reverse engineer, decompile, or disassemble any part of the platform.

All content, features, functionality, trademarks, and intellectual property associated with ServiceArc are owned by or licensed to Pomalo Corporation. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the platform without our prior written consent.

Certain features of ServiceArc may require payment of fees. All fees are stated in your subscription agreement or on servicearc.io. Fees are non-refundable unless otherwise stated. We reserve the right to change pricing with reasonable advance notice.

ServiceArc integrates with third-party services, including Twilio for SMS delivery. Your use of such third-party services is subject to their respective terms and policies. We are not responsible for the performance, availability, or practices of any third-party service provider.

SMS program: By providing your mobile number, you consent to receive recurring transactional text messages from the business you engage through ServiceArc — including appointment reminders, booking confirmations, invoices and payment links, and review requests. Message frequency varies based on your activity. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages.

ServiceArc is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Pomalo Corporation disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure, or that SMS messages will be delivered successfully in all cases.

To the maximum extent permitted by law, Pomalo Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of ServiceArc or SMS notification services, regardless of the theory of liability.

Our total aggregate liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Pomalo Corporation, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of ServiceArc, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to ServiceArc at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including intellectual property, indemnification, limitation of liability, and dispute resolution.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pomalo Corporation is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, unless you opt out within 30 days of accepting these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via servicearc.io, email, or SMS notification. Your continued use of ServiceArc following any modifications constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any applicable subscription agreements, constitute the entire agreement between you and Pomalo Corporation regarding your use of ServiceArc and supersede all prior agreements and understandings.
